Google’s AI overviews are under legal scrutiny as an American edtech firm has sued the tech giant for allegedly damaging online businesses with its AI-powered search previews. Reuters reported that in a lawsuit filed on Monday, a U.S. edtech company said Google, the internet search engine is eroding demand for original content and undermining publishers’ ability to compete with its AI-generated overviews

The online edtech firm, Chegg, provides textbooks on rentals, homework help, and tutoring. The company said, “This will eventually lead to a “hollowed-out information ecosystem of little use and unworthy of trust.” CEO Nathan Schultz said on Monday, “The company is now considering a sale or take-private transaction as a result.”

The court dispute is rooted in the manner that Google’s AI overviews display generated answers on the top of search pages. According to the U.S edtech giant, this mode reduces the incentive for users to visit original websites, harming content-oriented sites whose revenue comes from search traffic. The Google AI overview case has drawn new interest in Google AI issues, which have been building as artificial intelligence transforms search engines and finding information online.

Byju’s insolvency case is now threatening to unsettle India’s tech startup sector. Reuters reported that thousands of panic-stricken employees are now seeking to protect their careers and recover their dues due to the case.

Byju’s was once India’s largest startup with a market valuation of $22 billion. The startup had attracted global investors and gained popularity for providing online courses during the Covid-19 pandemic. However, it’s now caught up in a dispute with US investors seeking $1 billion in unpaid dues.

A Troubled Past

Byju’s insolvency story started earlier this year. In July, the startup faced insolvency for failing to pay its board dues amounting to $19 million. In recent years, the edtech startup has suffered many setbacks, including boardroom exits and a tussle with investors.

The Board of Control for Cricket in India filed a complaint with the India Companies Tribunal. The tribunal ruling commenced Byju’s bankruptcy proceedings which included the appointment of an interim resolution professional to oversee the management of the company after the board of directors was suspended.

Byju’s investors have accused the startup founder and CEO, Byju Raveendran, of lapses in corporate governance, collapse in valuation, and job cuts. Byju’s is battling the insolvency case as it seeks to regain control. In the papers filed in court, the company warned of a total shutdown as the insolvency case continues.

Last week, India’s Supreme Court declined Byju’s request to stop the insolvency process.

Employee Fears

Byju’s insolvency case affected many parents and employees. A review of WhatsApp chats and interviews by Reuters revealed growing desperation as affected people plan to take action against the edtech company, whose assets have been frozen.

A lot of people, including myself, have stopped taking classes because there’s no point doing charity for the company anymore,” Byju’s employee, Sukirti Mishra said.

Mishra taught mathematics at Byju’s and was earning $1200 each month. After halting classes, she faces anger from parents whose children she taught on the edtech platform. Having gone unpaid for months now, she struggles to pay medical bills and make loan repayments.

Byju’s 27000 employees have not been paid for three months. Most of them are considering suing the company and protesting on the streets.

About 3000 employees have filed salary claims and provided bank statements since the tribunal appointed an interim resolution professional. Through an internal memo released this week, Raveendran sought to array employees.

Our company is on the verge of reversing the negative business cycle that began two years ago, showing clear signs of recovery. I guarantee this: When we regain control, your salaries will be paid promptly,” he said.

Tough Road Ahead

But the road ahead could be long and tough for Byju’s employees as it could take months to liquidate company assets or get a new buyer. There are no legal guarantees that the workers will ultimately recover their dues.

An estimated 280 workers have asked a state grievance panel to take action on their unpaid salaries. In a letter dated August 5, the employees accused Byju’s of failing to remit taxes deducted from their salaries to the government.

We are deeply concerned about the company’s financial stability, our fear is that the company may be planning to shut down operations without settling our dues,” the employees wrote.

Byju’s customers fear that they’ll not be able to recover their money. The edtech startup has a 150 million student membership across 21 countries. Its programs cost between $100 and $300, with the majority being sold on loans.

Byju’s insolvency is set to be the largest in India’s tech startup landscape. Over the years, the industry has attracted investors such as Tiger Global and SoftBank.

The Software and Information Industry Association (SIIA) has warned that SIIA Title II compliance will be expensive. K12 Dive reported that Title II has a rule on online content accessibility. This rule requires EdTech companies and school districts to invest a considerable amount of money and time to comply.

Research by University of Chicago shows that EdTech substitutes tutoring time with high-quality educational content. The content is delivered through technology. EdTech enables institutions to reduce educational costs by a third. It also cuts back the number of tutors in schools by 50%. It does this without compromising on the impact of tutoring on students.

The Cost Aspect

The SIIA represents the digital content and software industry. The U.S. Department of Justice (DoJ) estimates that the time-consuming Title II Compliance will cost $1.134 billion for K-12 classroom courses. $5.5 billion will be required for post-secondary courses.

School districts will have to remediate current third-party websites. These processes are expected to cost an extra $113.8 million. A further $93.6 million will be required for higher education.

Web Content Guidelines

The Title II rule requires public institutions to adopt Version 2.1 of the Web Content Accessibility Guidelines. This compliance standard will ensure that mobile apps, websites, and digital textbooks have the right accessibility features. These features include images, text, videos, animation, sounds, and controls that are accessible.

Accessibility features may include web content used to support keyboard alternatives. These alternatives are necessary for mouse commands where users have limited manual dexterity. Visually impaired users need them to resize text. The standard also applies to posts on social media.

Several exceptions will be made to Title II compliance SIIA. For instance, social media posts that exist before the rule takes effect will not be affected. Content published on government websites or mobile applications by third-parties will not be affected.

Compliance Deadline

DoJ’s Title II rules will take effect by the end of June 2024. But, public universities and schools have two to three years to comply.

Vendors providing services to state and local government entities should be ready as the compliance dates come near,” the paper stated.

SIIA Title II compliance depends on the size of the population in a local jurisdiction or state. For instance, if a K-12 school is located in a city or county with 50,000 plus people, it should comply by April 24, 2026. Public universities in the same city would work with the same deadline. This is because they are state entities.

These timelines will change if K-12 school districts or community colleges in the same location have 49,999 or less. For these public institutions, the deadline for compliance will be April 26, 2027.

EdTech startup, Zen Educate has raised $37 million in a series B funding round. According to EU-Startups, the Zen Educate funding round is the largest in EU EdTech this year.

Led by Round2 Capital, this round of funding enlisted the support of investors who are already supporting the startup. These include Brighteye Ventures, Ascension Ventures, Adjuvo, and leading angel investors.

At the same time, Zen Educate has announced the acquisition of Aquinas Education, a teacher staffing agency. Both Zen Educate series B funding and the Aquinas Education acquisition place the EduTech startup squarely on the growth path. Zen Educate currently operates in 11 regions within the UK and 5 states in the US.

Zen Educate Teacher Shortage Crisis Solution

Founded in 2017, Zen Educate focuses on solving the teacher shortage problem in the UK and US. The company uses technology to connect teachers with schools. Just recently, research showed an imbalance between teacher demand and supply. According to the ADP Research Institute, demand for teachers in the US outweighs supply.

Zen Educate digitizes teacher recruitment by providing a digital platform where schools and teachers create profiles. The tech startup uses experience, skills, and proximity data to match the two parties according to their compatibility automatically.
